CONSTITUTION ARTICLE 1 NAME AND OBJECTIVES SECTION 1. THE NAME OF THE ORGANIZATION SHALL BE COUNTY ASSESSORS OF SOUTH CAROLINA. FOR REFERENCE PURPOSES IT MAY BE ABBREVIATED BY THE INITIALS CASC. SECTION 2. ITS OBJECTIVES SHALL BE (1) TO PROVIDE A CLEARINGHOUSE FOR THE COLLECTION AND DISTRIBUTION OF USEFUL INFORMATION RELATING TO REAL PROPERTY APRAISAL/ASSESSMENT PRACTICE; (2) TO COOPERATE WITH PUBLIC AGENCIES INTERESTED IN IMPROVING ASSESSMENT ADMINISTRATION; (3) TO RECOMMEND LAWS AND REGULATIONS WITH RESPECT TO ASSESSMENT ADMINISTRATION AND TO REVIEW AND ADOPT POSITIONS PROPOSED RULES AND REGULATIONS OF THE DEPARTMENT OF REVENUE; AND (4) TO WORK WITH OFFICERS AND MEMBERS OF THE SOUTH CAROLINA ASSOCIATION OF ASSESSING OFFICIALS AND THE SOUTH CAROLINA ASSOCIATION OF COUNTIES ON MUTUAL AREAS OF CONCERN. SECTION 3.  THE COUNTY ASSESSORS OF SOUTH CAROLINA WILL BE AN AFFILIATE MEMBER OF THE SOUTH CAROLINA ASSOCIATION OF COUNTIES AND THE PRESIDENT OF THE CASC, WITH THE ADVICE AND CONSENT OF A MAJORITY OF THE GOVERNING COUNCIL, WILL APPOINT ANY MEMBER REPRESENTATIVE(S) TO THE ASSOCIATION OF COUNTIES. ARTICLE II MEMBERSHIP SECTION 1.  REGULAR MEMBERS. EACH LEGALLY APPOINTED COUNTY ASSESSOR (ASSESSOR OF REAL PROPERTY) SHALL BE ELIGIBLE FOR MEMBERSHIP PROVIDED HE/SHE IS A MEMBER IN GOOD STANDING OF THE SOUTH CAROLINA ASSOCIATION OF ASSESSING OFFICIALS. SECTION 2ASSOCIATE MEMBERS.  EACH COUNTY ASSESSOR WHO IS A REGULAR MEMBER MAY APPOINT (2) ASSOCIATE MEMBERS FROM HIS/HER OFFICE PROVIDED THE ASSOCIATE MEMBERS ARE MEMBERS IN GOOD STANDING OF THE SOUTH CAROLINA ASSOCIATION OF ASSESSING OFFICIALS.            SECTION 2 (A) ASSOCIATE MEMBERS  SHALL INCLUDE THREE (3) EMPLOYEES OF THE DEPARTMENT OF REVENUE PROVIDED THEY ARE MEMBERS IN GOOD STANDING OF THE SOUTH CAROLINA ASSOCIATION OF ASSESSING OFFICIALS.  3.  VOTING RIGHTS.  THE RIGHT TO HOLD OFFICE IS RESERVED TO REGULAR MEMBERS EXCLUSIVELY, AND THE RIGHT TO VOTE IS RESERVED TO REGULAR MEMBERS EXCLUSIVELY PROVIDED IN THE ABSENCE OF THE REGULAR MEMBER. THE ASSOCIATE  MEMBER MAY CAST THE REGULAR MEMBER'S VOTE. SECTION 4.  DUES.  THE GOVERNING COUNCIL BY RESOLUTION SHALL ADOPT THE MEMBERSHIP DUES SCHEDULE WHICH SHALL BE SUFFICIENT TO COVER ONLY THE NECESSITIES OF PROVIDING INFORMATION TO ITS MEMBERS.  ALL DUES SHALL BE PAYABLE IN ADVANCE.  MEMBERS MAY BE SUSPENDED FROM MEMBERSHIP FOR NONPAYMENT OF MEMBERSHIP. ARTICLE III OFFICERS SECTION 1.  THE OFFICERS OF THE ORGANIZATION SHALL CONSIST OF THE (1) PRESIDENT, (2) VICE PRESIDENT AND (3) SECRETARY- TREASURER. SECTION 2SELECTION.  DURING THE ANNUAL MEETING THERE SHALL BE ELECTED A PRESIDENT, VICE PRESIDENT AND SECRETARY – TREASURER. ARTICLE IV GOVERNING COUNCIL SECTION 1.  GOVERNING BODY, THE GOVERNING BODY OF THE ORGANIZATION SHALL BE THE GOVERNING COUNCIL, WHICH SHALL HAVE POWER TO PASS ANY RESOLUTION OR BY-LAW IT MAY DEEM NECESSARY TO ACCOMPLISH THE PURPOSES, OF THE ORGANIZATION AND WHICH IS NOT IN CONFLICT WITH ANY OF THE PROVISIONS OF THIS CONSTITUTION. SECTION 2.  GOVERNING COUNCIL.  THE GOVERNIING COUNCIL SHALL CONSIST OF THE PRESIDENT, VICE PRESIDENT AND SECRETARY-TREASURER, AS OFFICERS AND FOUR (4) OTHER MEMBERS ELECTED BY THE VOTING MEMBERS.  TERM PROVIDED INITIALLY WITH THE ADOPTION OF THIS CONSTITUTION TWO MEMBERS SHALL BE ELECTED FOR A ONE-YEAR TERM AND TWO MEMBERS ELECTED FOR A TWO-YEAR TERM. ARTICLE V DUTIES OF OFFICERS SECTION 1.  PRESIDENT.  THE PRESIDENT SHALL BE THE CHAIRPERSON OF THE GOVERNING COUNCIL AND PRESIDE AT ALL MEETINGS OF REGULAR MEMBERS HELD FOR THE PURPOSE OF TRANSACTING ORGANIZATION BUSINESS.  THE PRESIDENT SHALL MAKE ALL NECESSARY COMMITTEE AND OTHER APPOINITMENTS EITHER ON HIS/HER OWN  INITIATIVE OR  AT THE REQUEST OF THE GOVERNING COUNCIL AND SHALL PERFORM SUCH DUTIES AS MAY FROM TIME TO TIME BE ASSIGNED BY THE GOVERNING COUNCIL. SECTION 2.  VICE PRESIDENT.   THE VICE PRESIDENT SHALL EXERCISE THE POWERS AND DUTIES OF THE PRESIDENT DURING THE PRESIDENT'S ABSENCE OR INABILITY TO ACT AND SHALL PERFORM SUCH OTHER DUTIES AS MAY BE ASSIGNED BY THE GOVERNING COUNCIL. SECTION 3.  SECRETARY-TREASURER.  THE SECRETARY-TREASURER SHALL BE THE CHIEF FINANCIAL AGENT OF THE ORGANIZATION AND SHALL EXERCISE SUCH AUTHORITY AND PERFORM SUCH DUTIES AS MAY BE PRESCRIBED BY THE GOVERNIING COUNCIL.  THE SECRETARY-TREASURER OF THE ORGANIZATION SHALL GIVE NOTICE AND KEEP MINUTES OF ALL MEETINGS. ARTICLE VI MEETINGS SECTION 1.  ANNUAL MEETING.  THE ANNUAL MEETING OF THE MEMBERS SHALL BE HELD AT SUCH TIME AND PLACE AS MAY BE DETERMINED BY THE GOVERNING COUNCIL. SECTION 2.  NOTICE.  AT LEASE THREE (3) DAYS NOTICE OF THE TIME, PLACE AND PURPOSE OF ALL SPECIAL MEETINGS OF THE COUNCIL SHALL BE GIVEN ALL MEMBERS OF COUNCIL BY THE SECRETARY-TREASURER.  SUCH NOTICE MAY BE GIVEN IN PERSON, BY TELEPHONE, BY MAIL, OR BY TELEGRAM SENT TO THE MEMBERS' LAST KNOWN ADDRESS. ARTICLE VII ELECTION OF OFFICERS AND COUNCIL MEMBERS SECTION 1.  NOMINATING COMMITTEE  THE PRESIDENT SHALL APPOINT EACH YEAR, NOT LESS THAN FORTY-FIVE (45) DAYS PRIOR TO THE ANNUAL MEEETING OF THE ORGANIZATION, A NOMINATING COMMITTEE CONSISTING OF FIVE (5) REGULAR MEMBERS IN GOOD STANDING AS A CANDIDATE FOR THE OFFICE OF PRESIDENT AND, IF FEASIBLE, NOT FEWER THAN TWO (2) NAMES FROM THE REGULAR MEMBERS IN GOOD STANDING AS CANDIDATES FOR THE POSITION OF VICE PRESIDENT, SECRETARY-TREASURER AND FOR EACH OFFICE AND PLACE TO BE FILLED ON THE GOVERNING COUNCIL.  THE NOMINATION BY THE NOMINATING COMMITTEE SHALL BE FORWARDED TO THE SECRETARY-TREASURER WHO SHALL PUBLISH THE NAMES TO ALL REGULAR MEMBERS AT LEAST TWENTY (20) DAYS BEFORE THE ANNUAL MEETING. SECTION 2.  ELECTION.  AFTER THE SLATE OF THE NOMINATING COMMITTEE HAS BEEN READ TO THE REGULAR MEMBERS AT THE ANNUAL MEETING, THE PRESIDENT SHALL THEN CALL FOR NOMINATIONS FROM THE FLOOR.  AFTER THE CALL FOR NOMINATIONS, THE CANDIDATES SHALL BE ELECTED BY SECRET BALLOT. ARTICLE VIII AMENDMENTS TO THE CONSTITUTION SECTION 1HOW PROPOSED.  AMENDMENTS MAY BE PROPOSED EITHER BY (1) RESOLUTION ADOPTED BY THE GOVERNING COUNCIL OR (2) PETITION SIGNED BY NOT LESS THAN (20) PERCENT OF THE TOTAL NUMBER OF REGULAR MEMBERS AT THE TIME OF THE PROPOSAL.  THE SECRETARY-TREASURER SHALL FORTHWITH NOTIFY ALL REGULAR MEMBERS OF THE FULL TEXT OF EACH PROPOSED AMENDMENT AND THE DATE SET BY THE GOVERNING COUNCIL WHEN THE VOTING SHALL TAKE PLACE ON THE PORPOSED AMENDMENT. SECTION 2.  HOW AMENDED.  THIS CONSTITUTION MAY BE AMENDED BY A MAJORITY OF THE VOTING MEMBERS PRESENT AND IN GOOD STANDING.  NO AMENDMENT SHALL BECOME EFFECTIVE UNLESS APPROVED BY A MAJORITY OF MEMBERS PRESENT AND VOTING IN SUCH ELECTION. ARTICLE IX MISCELLANEOUS PROVISIONS SECTION 1.  FISCAL YEAR.  THE FISCAL YEAR OF THE ORGANIZATION SHALL BE FROM JULY 1 TO JUNE 30 OF EACH YEAR. SECTION 2.  PROHIBITIONS.  THE ORGANIZATION SHALL NOT CONDUCT, OR CARRY ON, ANY ACTIVITIES NOT PERMITTED TO BE CONDUCTED OR CARRIED ON BY AN ORGANIZATION EXEMPT UNDER SECTION 501 (C) (3) OF THE INTERNAL REVENUE CODE AND ITS REGULATIONS AS THEY NOW EXIST OR AS THEY MAY HEREAFTER BE AMENDED, OR BY AN ORGANIZATION, CONTRIBUTIONS, TO WHICH ARE DEDUCTIBLE UNDER SECTION 170 (C)  (2) OF THE AFORESAID CODE AND REGULATIONS AS THEY NOW EXIST OR AS THEY MAY HEREAFTER BE AMENDED. SECTION 3.  DISSOLUTIONS.  THE DISSOLUTION OF THE ORGANIZATION OR THE WINDING UP OF ITS AFFAIRS, THE ASSETS OF THE ORGANIZATION SHALL BE DISTRIBUTED EXCLUSIVELY TO CHARITABLE, RELIGIOUS, SCIENTIFIC, TESTING FOR PUBLIC SAFETY, LITERARY OR EDUCATIONAL ORGANIZATIONS WHICH WOULD THEN QUALLIFY UNDER THE PROVISIONS OF SECTION 501 (C)  (3) OF THE INTERNAL REVENUE CODE AND ITS REGULATIONS AS THEY NOW EXIST OR AS THEY MAY HEREAFTER BE AMENDED, OR THE FEDERAL, STATE, OR LOCAL GOVERNMENT FOR EXCLUSIVELY PUBLIC PURPOSES. SECTION 4.  EFFECTIVE DATE.  THE PROVISIONS OF THE CONSTITUTION WILL BECOME EFFECTIVE IMMEDIATLEY UPON ITS RATIFICATION BY THE MEMBERS. INITIAL CONSITITUTION RATIFIED BY TWENTY-NINE (29) ASSESSORS IN ATTENDANCE AT THE CAROLINA INN IN COLUMBIA ON DEC 12, 1978.  ON DECEMBER 13, 1978 AN ADDITIONAL ELEVEN (11) COUNTY ASSESSORS CONCURRED. THE GOVERNING  COUNCIL OF CASC MET APRIL 29, 1992, AND RECOMMENDED THE FOLLOWING AMENDMENTS TO THE CONSTITUTION. (1) OFFICE OF CHAIRMAN TO BE CHANGED TO PRESIDENT - - THIS TERMINOLOGY WOULD BE CHANGED THROUGHOUT THE CONSTITUTION. (2) OFFICE OF VICE CHAIRMAN TO BE CHANGED TO VICE PRESIDENT  THIS TERMINOLOGY WOULD BE CHANGED THROUGHOUT THE CONSTITUTION. (3)ARTICLE III, SECTION 2 - - TERM OF OFFICE CHANGED FROM ONE YEAR TO TWO YEARS; THIS IS IN AN EFFORT TO COINCIDE OFFICES WITH THE S.C. LEGISLATIVE CALENDAR. (4) ARTICLE IV, SECTION - - DELETE REFERENCE TO ANNUAL MEETING BEING HELD AT THE SAME TIME AND PLACE AS THE ANNUAL CONFERENCE OF THE SOUTH CAROLINA ASSOCIATION OF COUNTIES.  THE GOVERNING COUNCIL MAY DETERMINE THE TIME AND PLACE OF ANNUAL CONFERENCE. (5) ARTICLE IX, SECTION 1 - - FISCAL YEAR CHANGED FROM CALENDAR YEAR TO JULY 1 THROUGH JUNE 30. THE GOVERNING COUNCIL ALSO RECOMMENDED TO THE MEMBERSHIP, ON MAY 2, 1992, THAT IN ACCORDANCE WITH ARTICLE II, SECTION 4, MEMBERSHIP DUES BE INCREASED TO TEN DOLLARS ($10.00).  THE MEMBERSHIP VOTED AND THIS RECOMMENDATION CARRIED.  THE $10.OO WILL BECOME EFFECTIVE FOR 1992 AND WILL BE BILLED AFTER JULY 1. A MOTION WAS MADE, SECONDED AND APPROVED UNANIMOUSLY AT THE AUGUST 9, 1996, MEETING IN ACCORDANCE WITH ARTICLE II, SECTION 4, TO INCREASE ANNUAL DUES TO $20.00.  THE INCREASE WILL BECOME EFFECTIVE FOR THE 1996-97 YEAR. THE GOVERNING COUNCIL MET FEBRUARY 14, 1997, AND RECOMMENDED THE FOLLOWING AMENDMENT TO THE CONSTITUTION. (1) ARTICLE II, SECTION 2 – EACH COUNTY ASESSOR WHO IS A REGULAR MEMBER MAY APPOINT TWO (2) ASSOCIATE MEMBERS FROM HIS/HER OFFICE PROVIDED THE ASOCIATE MEMBER IS A MEMBER IN GOOD STANDING OF THE SOUTH CAROLINA ASSOCIATION OF ASSESSING OFFICIALS.  THE RECOMMENDATION WAS UNANIMOUSLY APPROVED AT THE APRIL 25, 1997, MEETING OF THE MEMBERS. THE GOVERNING  COUNCIL OF CASC MET APRIL 27, 2007, AND RECOMMENDED THE FOLLOWING AMENDMENTS TO THE CONSTITUTION. (1) ARTICLE II, SECTION 2 (A), ASSOCIATE MEMBERS SHALL INCLUDE THREE (3) EMPLOYEES OF THE DEPARTMENT OF REVENUE PROVIDED THEY ARE MEMBERS IN GOOD STANDING OF THE SOUTH CAROLINA ASSOCIATION OF ASSESSING OFFICERS A MOTION WAS MADE, SECONDED AND APPROVED BY THE MAJORITY AT THE APRIL 27, 2007 MEETING  OF THE MEMBERS.
